Fuel station ban goes to State appeal

The proponent of a fuel station at Albany’s Chester Pass Road roundabout has appealed the City of Albany’s decision to block the controversial development.

The City of Albany rejected the application for a $2.4 million service station on the busy round- about at its meeting last month after a raft of public criticism of the proposal amid safety concerns.

Albany Mayor Dennis Wellington said the City planned to defend its decision after the appeal was lodged by the proponent, Procon Developments, at the State Administrative Tribunal.

The proposed service station and lunch bar would be on the corner of Chester Pass Road and Albany Highway and was expected to attract more than 1000 vehicles a day.

The City will attend a directions hearing tomorrow to determine a course of action, which is expected to be mediation.

However, Mr Wellington said he was sceptical an agreement would be made between the City and Procon Developments.

“Obviously our position is safety,” he said. “It will be interesting to see how they say it is not going to increase the risk.

“But it is up to them and up to us to make that decision when we get there.

“We certainly will be defending (our decision) once we get there.

The appeal was lodged last week and Mr Wellington said the City was confident it had a strong argument against the appeal.

“RAC issued a report on the most dangerous intersections and (the roundabout) was ranked No.6 in the State and No.2 in the region,” he said.

“It is a safety concern.

“You can go there on any one day to see the problems there.

“You wouldn’t want to increase the risk where someone’s life (could) be in danger.”

Procon Developments managing director Leon Key was contacted for comment.

Mr Wellington said he expected a hearing would be held in the next fortnight.
